Terms and Conditions of Sale
1. Introduction
These general terms and conditions of sale (GTC) govern all orders placed on the Lilit Fleurs website (www.lilitfleurs.eu). By placing an order, the customer unconditionally accepts these conditions. Lilit Fleurs reserves the right to modify the GTC at any time; the applicable conditions are those in force on the date of the order.
2. Products
Lilit Fleurs offers for sale fresh flower bouquets, floral compositions, plants, and various decorative items. Product photographs on the website are non-contractual and may differ from reality depending on seasons, availability, and the artisanal nature of each creation.
2bis. Flower and Plant Subscriptions
Lilit Fleurs offers flower or plant subscriptions according to the customer’s choice and preferences:
- Delivery frequency: The customer chooses the desired number of deliveries, either weekly or monthly, according to available options.
- Subscription themes: Compositions are created according to the theme chosen by the customer: Office flower subscription, Flower subscription for mom, Love flower subscription, Friendship subscription, or plant subscription, etc.
- Photos for illustrative purposes: The photographs displayed on the website are examples of flowers or plants. The exact composition may vary depending on seasons, availability, and the expertise of our certified artisan florists, while respecting the selected theme and quality.
- Limited customization: The customer cannot choose their own composition flower by flower, but decides only on the type of subscription, frequency, and theme. Our certified artisan florists then create a unique and tailored composition.
- Delivery or pickup: Subscriptions can be delivered to the address chosen by the customer or collected free of charge from one of the four Lilit Fleurs stores in Brussels, at the customer’s choice.
- Cancellation: The customer may cancel their subscription at any time, without fees or commitment, via their customer account or by contacting customer service.
- Collection of old plants: Upon customer request, Lilit Fleurs can collect old plants when delivering new ones, as part of an eco-friendly service.
3. Adding Alcohol to Orders
When a bottle of wine is added to a bouquet, the sale is subject to Belgian legislation prohibiting the sale of alcohol to minors under 18. The delivery person is authorized to request identification to verify the recipient’s age. If the recipient is a minor, the bottle will not be delivered and no refund will be issued for this item.
4. Orders
Orders can be placed online on the website www.lilitfleurs.eu. After validation, the customer will receive a confirmation email. Lilit Fleurs reserves the right to cancel or refuse an order in case of an existing dispute with the customer or for any other legitimate reason.
5. Delivery Methods
All deliveries are carried out exclusively by Lilit Fleurs delivery personnel, ensuring a careful and personalized service.
- Same-day delivery or chosen date: The customer selects an available date and time slot during the ordering process.
- Respect for time slots: Time slots are indicative. In case of force majeure (weather conditions, traffic problems, accidents, strikes, unforeseen events) or during high-demand periods such as Valentine’s Day, Mother’s Day, or other exceptional events, the chosen delivery time may not be strictly respected. No refund may be claimed for this reason.
- Specific deadlines: Certain flowers or compositions require a preparation time of up to 48 hours. This information is specified during the ordering process.
- Delivery fees: Delivery costs are not included in the product price and depend on the distance between the Lilit Fleurs store and the delivery address. For subscriptions, delivery fees are added to the price of each delivery. The exact amount is indicated before order validation.
- Click and Collect: Option to collect your order free of charge from one of the four Lilit Fleurs stores in Brussels.
5bis. Identity Verification
To prevent fraud and ensure transaction security, Lilit Fleurs reserves the right to request proof of identity upon delivery or in-store pickup. In case of refusal, the order may not be handed over without entitlement to a refund.
6. Prices and Special Conditions
Prices displayed on the website are in euros, VAT included, excluding delivery fees. Discounts or special offers may be offered according to the conditions mentioned at the time of purchase. These offers cannot be combined. For subscriptions, the displayed price corresponds to the product only; delivery fees are added to each shipment according to the chosen delivery address.
7. Specifics during Valentine’s Day and Mother’s Day
During events such as Valentine’s Day and Mother’s Day, flower prices may increase at the producer level, which may impact rates. Lilit Fleurs maintains a high quality standard:
- Generous bouquets composed of fresh flowers.
- Careful packaging adapted to the event.
- Special attention given to each order.
- Personalization options to make each bouquet unique.
8. Payment
Payment is made online by credit card or any other method offered on the website. Transactions are secured via an SSL protocol.
- Automatic payment for subscriptions: Following the first online or in-store purchase, the customer may authorize automatic debit from their bank account for the recurring payment of their subscription. This debit occurs according to the chosen frequency (weekly or monthly).
- Debit issue: In case of a debit problem (insufficient funds, expired card, dispute, etc.), the subscription is automatically suspended. The customer is notified multiple times by email and/or SMS. If the issue is not resolved within a reasonable timeframe, the subscription is permanently terminated without additional charges to the customer.
9. Returns, Exchanges, and Claims Policy
As flowers, plants, and floral compositions are perishable, handmade products, no returns or exchanges are accepted, including for subscriptions. The customer cannot exchange their flower or plant bouquet for another model. Any claim regarding the quality or conformity of a delivery must be submitted within 24 hours of receipt, by email to fleurslilit@lilitfleurs.eu or by phone at 0487 11 81 18.
10. Intellectual Property
All content on the website www.lilitfleurs.eu is protected by intellectual property rights. Any unauthorized reproduction is prohibited.
11. Data Protection
Collected data is used exclusively for order processing, subscription management, and service improvement. Lilit Fleurs complies with Belgian legislation regarding data protection. The customer has the right to access, rectify, and delete their personal data.
12. Applicable Law and Competent Jurisdiction
These GTC are governed by Belgian law. Any dispute will be submitted to the competent courts of Brussels.
